AGREEMENT TO OUR LEGAL TERMS

We are iLove VPN ("Company", "we", "us", "our"), registered at THE CORE, TRIQ IL- WIED TA' L-IMSIDA, MSIDA, MSD 9021, Malta. We operate the mobile application iLove VPN (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

iLove VPN is a privacy-first, no-logs VPN built on the WireGuard® protocol.

These Legal Terms constitute a legally binding agreement between you and iLove VPN concerning your access to and use of the Services. By accessing or using the Services, you agree to be bound by these Legal Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.

If you obtained the App from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement (EULA) (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). Where these Legal Terms conflict with Apple's standard EULA, the terms more protective of you as a consumer apply.

We reserve the right to change these Legal Terms; the "Last updated" date will reflect any changes. You must be at least 16 years old (or the age of digital consent where you live) to use the Services.

1. OUR SERVICES

The Services provide an encrypted VPN connection that routes your internet traffic through a server in a country you choose. The information provided when using the Services is not intended for distribution to, or use by, any person in a jurisdiction where such use would be contrary to law. You are responsible for compliance with local laws, including any local restrictions on the use of VPN technology.

2. INTELLECTUAL PROPERTY RIGHTS

We own or license all intellectual property rights in the Services, including the software, source code, designs, and trademarks ("Marks"). We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own lawful, non-commercial use. No part of the Services may be copied, reproduced, reverse engineered, or commercially exploited without our prior written permission, except as allowed by law. "WireGuard" is a registered trademark of Jason A. Donenfeld; we use the protocol but are not affiliated with the WireGuard project.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Legal Terms; (2) you are not a minor in your jurisdiction, or you have parental consent; (3) you will not access the Services through automated or non-human means except via our official App; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use will not violate any applicable law.

4. SUBSCRIPTIONS AND ACCOUNT

The App does not require you to create a username/password account. Access is tied to your Apple ID subscription via the Apple App Store. You are responsible for activity that occurs through your device and your Apple ID.

5. FEES AND PAYMENT

The Services are offered through auto-renewable subscriptions sold via the Apple App Store, using Apple's In-App Purchase system. Payment is charged to your Apple ID, not to us — we do not collect or store your payment details. Plans, durations, and prices are shown in the App before purchase and may vary by region and currency. Prices may change; any change will apply to future billing periods and, where required, only after notice and your consent.

Note: Because the App is distributed on the Apple App Store, digital subscriptions are sold exclusively through Apple In-App Purchase. We do not accept credit cards or bank transfers directly in the App.

6. FREE TRIAL

We may offer a free trial to new subscribers. The trial length and terms are shown at the point of purchase in the App. Unless you cancel before the trial ends, your subscription will begin and your Apple ID will be charged for the plan you selected. Any unused portion of a free trial is forfeited upon purchase of a subscription.

7. CANCELLATION AND REFUNDS

You can manage or cancel your subscription at any time in Settings → your Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current billing period; you keep access until then. Refunds are handled by Apple under Apple's refund policy; we generally cannot grant refunds directly — please contact Apple Support.

8. PROHIBITED ACTIVITIES

You may not use the Services for anything other than the purpose we provide them. Prohibited activities include, without limitation: violating any law; sending spam or unsolicited bulk messages (outbound SMTP/port 25 is blocked); distributing malware or launching attacks; scanning, probing, or breaching others' systems; infringing intellectual property; distributing illegal content; harassing, defrauding, or harming others, including exploiting minors; reselling or sharing the Services with third parties; circumventing security or usage limits; and reverse engineering the Services except where permitted by law. We may suspend or terminate access that violates this section, including to resolve abuse complaints from our providers.

9. USER GENERATED CONTRIBUTIONS

The Services do not generally invite you to post public content. If you submit any content (for example, a support message or a review), you represent that it is accurate, lawful, not misleading, and does not infringe the rights of any third party.

10. CONTRIBUTION LICENSE

If you submit feedback, suggestions, or other content to us, you grant us a non-exclusive, worldwide, royalty-free license to use it to operate and improve the Services. You retain any ownership rights you hold in your content.

11. GUIDELINES FOR REVIEWS

If you leave a review (for example, on the App Store), it should be based on genuine firsthand experience, be truthful, and avoid offensive, discriminatory, or unlawful content. Reviews must not be false or part of a coordinated campaign.

12. SUBMISSIONS

Any questions, comments, suggestions, or other information you send us regarding the Services ("Submissions") are non-confidential and become our property. We may use them for any lawful purpose without acknowledgment or compensation.

13. ADVERTISERS

The App does not display third-party advertising. This section is intentionally left as not applicable.

14. U.S. GOVERNMENT RIGHTS

The Services are "commercial items" as defined under applicable U.S. Federal Acquisition Regulations and are provided to U.S. Government end users only as commercial items and with the rights granted to all other end users under these Legal Terms.

15. SERVICES MANAGEMENT

We reserve the right to monitor the Services for violations, take appropriate legal action against violators, and manage the Services to protect our rights and the operation of the network, including by suspending abusive accounts.

16. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by it. We operate a no-logs VPN and do not sell or disclose your data to third parties for any purpose, consistent with App Store Guideline 5.4.

17. COPYRIGHT INFRINGEMENTS

We respect intellectual property rights. If you believe material accessible via the Services infringes your copyright, please notify us at info [at] ilovevpn.app. Note that under applicable law you may be liable for damages if you make a material misrepresentation in a notice.

18. TERM AND TERMINATION

These Legal Terms remain in effect while you use the Services. We may, in our sole discretion and to the extent permitted by law, suspend or terminate your access if you breach these Legal Terms or applicable law, or where necessary to operate the Services safely and lawfully.

19. MODIFICATIONS AND INTERRUPTIONS

We may change, modify, or remove the Services (including servers, countries, features, or plans) at any time without notice. We are not liable for any modification, price change, suspension, or discontinuance of the Services, except as required by law. We do not guarantee the Services will be available at all times and may experience interruptions or maintenance.

20. GOVERNING LAW

These Legal Terms are governed by the laws of Malta, without regard to its conflict-of-law rules. Mandatory consumer-protection rights of your country of residence continue to apply.

21. DISPUTE RESOLUTION

Informal negotiations. Before bringing a formal dispute, you agree to try to resolve it informally by contacting us, for at least 30 days.

Binding arbitration / courts. Any dispute not resolved informally will be resolved by the competent courts of Malta, or by binding arbitration if required by local law. To the extent permitted, disputes will be conducted on an individual basis and not as a class action. Claims relating to intellectual property, or requests for injunctive relief, are excluded from any arbitration requirement. EU consumers may also use the European Commission's Online Dispute Resolution platform.

22. CORRECTIONS

The Services may contain typographical errors or inaccuracies. We reserve the right to correct any errors and to update information at any time without prior notice.

23. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. A VPN IMPROVES PRIVACY BUT DOES NOT MAKE YOU ANONYMOUS OR GUARANTEE ACCESS TO ANY PARTICULAR CONTENT.

24. LIMITATIONS OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID (VIA APPLE) IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.

25. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from any loss or claim arising out of your use of the Services, your breach of these Legal Terms, or your violation of any law or the rights of a third party.

26. USER DATA

We maintain certain operational data to provide the Services as described in our Privacy Policy. You are responsible for your own use of the Services. We are not liable for loss or corruption of data, except as required by law.

27. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using the Services you consent to receive electronic communications, and you agree that electronic agreements, notices, and records satisfy any legal requirement that such communications be in writing.

28. CALIFORNIA USERS AND RESIDENTS

If a complaint is not resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210.

29. MISCELLANEOUS

These Legal Terms and any policies posted by us constitute the entire agreement between you and us. Our failure to enforce any provision is not a waiver. If any provision is found unlawful or unenforceable, it is severable and does not affect the remaining provisions. There is no joint venture, partnership, or employment relationship created by these Legal Terms.
